Was there “any way
to consider the old slaves,” the authors
of the appeal asked the President, some way of “giving us
pensions in payment for our long days of servitude?”
The answer, as on previous occasions, was no, but the timing
is noteworthy. One year later, Roosevelt signed legislation
creating the Social Security system – a system from which
agricultural and domestic workers, the two largest black employment categories, were excluded. "Thank you for taking a courageous stand. "Formerly no one was allowed to think freely; now it is permitted, but no one is capable of it any more. Now people want to think only what they are supposed to think, and this they consider freedom.": Oswald ." Mercy Otis Warren 1728-1814, poet, historian, patriot, and advocate of the Bill of Rights
Clearly there is no
magical formula for righting historical wrongs.
Retrospective justice is a messy and imperfect
business, and societies and institutions that undertake
it should do so with humility and a clear-eyed
recognition of the inadequacy of any reparative program to restore what was taken away. From: Yahoo! Alerts <alerts@yahoo-inc.com> Subject: Breaking News To: justcoolinout@yahoo.com Date: Wednesday, February 23, 2011, 2:20 PM

CONCLUSION
Litigation is a viable tool for obtaining reparations for African
descendants if the legal claim is clearly identified and various procedural
hurdles can be successfully mounted. Three procedural
hurdles that must be addressed at the initial stages of litigation—
standing, statute of limitations and sovereign immunity—can be
met using the experiences of African descendants. Honoring the
experiences and voices of those who seek reparations is imperative
if the ultimate remedy is to heal the wounds of centuries of disdainful,
brutal and inhumane treatment that the international community
acknowledges as a crime against humanity. | |
